NEW RULES

No Kenya for those suspected for less than five years

With eTA, the government requests information and acts accordingly

No foreign travellers, of any nationality, who are involved in trials or suspected of crimes in the country where they reside, for no more than five years, will be allowed to travel to Kenya. They will be banned from travelling in advance or at the very least will be monitored on arrival, in consultation with the authorities of the country they come from.

This was stated by the Ministry of the Interior in recent days, as reported by the Kenyan mainstream media.
With the introduction of the eTA, the electronic travel authorisation, which has replaced the entry visa (which is now issued free of charge, for the first three months, on arrival, but after the trip has been authorised on the basis of the information provided by the tourist), Kenya will retain the data of visitors suspected of crimes for up to five years, and then pass them on to the competent authorities of the country they come from. This will ensure, in the intentions of the Kenyan government, that agencies involved in investigations have 'adequate' time to conclude their enquiries and ensure that those suspected of crimes such as drug trafficking, smuggling, arms trafficking and money laundering, as well as clearly murder and other more serious offences, are easily traced and possibly arrested.

Since 1 January, Kenya has started allowing foreigners to arrive by plane without a visa, but now requires them to submit personal data days before arrival, sent to the Immigration Office via the eTA portal.
The data includes biographical information, the travel itinerary and any other information about the visitor, including precisely the traveller's lack of criminal proceedings in the last five years. Airlines are prohibited from boarding passengers whose entry has not been authorised through the ETA portal. 'Most of the crimes mentioned are cross-border, traditionally require long investigation periods and require joint investigations between security agencies of different countries, which explains why Kenya opted for the legal deadline of five years,' reports The East African newspaper.
