To be Kenyan residents: how to relate with Italy

Taxes and health for italians willing to come to Kenya

The desire to think about a permanent move to Kenya is back.
First the pandemic, then the war and the general insecurity about the future have put not only pensioners in front of the choice to live a quieter life following their desires. Of course, not everyone can afford it, but those who have, for example, one or more houses to rent or a good pension, can easily think about it.
Those who decide to move to Kenya can do so as tourists, but in this case they must leave the country every six months (forget the subterfuge used up until a short time ago, trusting that they were residing in one of the most corrupt nations in Africa, today there are also telematic controls due to anti-terrorism and they risk going directly to prison).
Or it can choose to reside in Kenya.
In this case, after complying with the obligations to become one (see the section on residence and work permits by clicking here), it is mandatory to enroll in AIRE, the Italian Association of Residents Abroad, notify the Embassy of the new address and access the status of "Italian resident abroad in a country without conventions".
In fact, in a few months things may change, but for now Kenya is not among the countries that have signed a bilateral convention against double taxation with Italy.
In this case the eventual pension will be taxed in Italy and, in case it contributes to create income for work, also in Kenya.
Fiscal Residence
In order to be considered resident abroad for tax purposes it is mandatory not to have been registered in the registry of residents in Italy for more than 183 days per year and not to have had domicile or habitual residence in Italy for more than half a year.
The Italian resident in Kenya also loses the right to health care in his country of origin (except for workers of Italian law on secondment).
Upon return to Italy you can still get a temporary health card that can last 90 days per year (cumulative), as a rule usable only for urgent hospital services.
All this can be obtained with a simple self-certification, presenting oneself in the municipality where one is temporarily domiciled.
In case of illness, it is also possible to obtain a general practitioner of the mutual society and exemptions on certain medicines or treatments.
Those who have income in Italy will have to continue to pay the regional and municipal IRPEF surcharges for as long as these taxes remain active, and if they continue to produce income in both countries, the deductions and tax credits due can be subtracted from the income produced abroad that has been subject to the final withholding tax.
